Foreclosure Fraud in Nevada is a Felony!

Nevada now leads the way in making it a felony offense for your lender to illegally and/or fraudulently foreclose on your property.

It was no mistake!

The bank purposely scheduled the auction of your home for a federal holiday — even Thanksgiving or Christmas.

If you’ve got that notice telling you that your auction is scheduled for a day that you believe can’t be right, do not make the fatal mistake of assuming that it is in error!  In many states, the sale is conducted on the court house steps, not inside, so the courthouse does not have to be open for the Attorney/Auctioneer to sell the home.

Lender’s latest ploy to foreclose — watch out this one sneaks up on you!

Single Point of Contact

The lenders are now mandated to provide a single point of contact for homeowners to be in touch with throughout the modification process.  You are lucky if they respond to you.  In most cases, you call into your lender to get an update and all you hear is that only your SPOC can give updates.   Leave a message for your SPOC and you get no response.  Loan mods are being closed because the SPOC puts in their notes, they never had contact with homeowner… even when they were calling daily!

This becomes fuel for the foreclosure:  “Your honor,” says the lender’s attorney, “Several attempts to contact the homeowner were made, and we have here in our notes that they never responded, to our calls.”

Innovative Attorneys pursue loan mods in the court room these days!

More and more, Tila is hearing that attorneys will not “play nice” anymore with the lenders.  Why? Because lenders don’t “play nice” when it comes to loan mods and foreclosures.  Many Loan Mod Attorneys take the lender to court to get the mods done now — I think we will see it as  a growing trend.  Word has it that this is where the principal balance reductions are actually happening!
